2. General conditions of use of the Site and the services offered
2.1. Use of the Site implies full and unreserved acceptance of the general conditions of use (" GCU ") described below. These conditions of use may be modified or supplemented at any time, and Site users are therefore advised to consult them regularly.
2.2. The Site is normally accessible to Users at all times. MEDRIA may, however, decide to interrupt the Site for technical maintenance purposes, in which case it will endeavor to inform Users of the dates and times of the intervention in advance.
2.3. The Site may be updated regularly by MEDRIA. In the same way, the legal notice and GTCU may be modified at any time: they are nevertheless binding on the User, who is invited to refer to them as often as possible in order to take cognizance of them.
3. Description of services provided
3.1 Site sections
The purpose of the Site is to provide information concerning :
- the presentation of MEDRIA, its activities through its solutions and its markets;
- MEDRIA's contact details and the possibility of sending a message.
3.2. Content limitations.
3.2.1. MEDRIA endeavors to provide information on the Site that is as accurate as possible. However, MEDRIA shall not be held liable for any omissions, inaccuracies or failure to update such information, whether caused by MEDRIA or by third-party partners supplying such information.
3.2.2. All information on the Site is provided for information purposes only, and is subject to change. Furthermore, the information on the Site :
- is not exhaustive ;
- is provided subject to modifications having been made since it was put on line and not yet updated on the Site.-
4 Contractual limitations on technical data

4.2 MEDRIA cannot be held responsible for any material damage resulting from use of the Site. In addition, the User undertakes to access the Site using recent, virus-free hardware and with an up-to-date, latest-generation browser.-
5. Intellectual property and counterfeiting
5.1. MEDRIA is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the Site, in particular the texts, images, graphics, logos, icons, sounds and software.
5.2. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Site, whatever the means or process used, is forbidden, except with the prior and express written authorization of MEDRIA.
5.3. Any unauthorized use of the Site or of any of the elements it contains will be considered as constituting an infringement and may be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.-
6. Limitation of liability
6.1. Direct and indirect damages. MEDRIA may not be held liable for direct or indirect damage (such as loss of business or loss of opportunity, for example) caused to the User's equipment when accessing the Site :
and resulting from :
- either the use of equipment that does not meet the specifications indicated in Article 4 "Contractual limitations on technical data" of the GCU,
- the appearance of a bug or incompatibility, or,
resulting from use of the Site.
6.2. Interactive areas. Interactive areas (possibility of sending a message via the "Contact" and "Contact us" areas) are available to the User. MEDRIA reserves the right to delete, without prior notice, any content posted in this area that contravenes the laws and regulations applicable in France, in particular those relating to the protection of Personal Data. MEDRIA also reserves the right to hold the User civilly and/or criminally liable, in particular in the event of messages of a racist, xenophobic, homophobic, anti-Semitic, abusive, defamatory, paedophilic or pornographic nature, whatever the medium used (text, images, photographs, etc.).
6.3. Site security notice. In order to ensure the security of the Site and to guarantee its access to all Users, MEDRIA may use software to monitor flows on the Site, to identify unauthorized attempts to connect or change information, or any other initiative that may cause damage. Unauthorized attempts to upload information, to alter information, to cause damage and in general to undermine the availability and integrity of the Site are strictly prohibited and punishable by law. In fact, the act of fraudulently accessing or remaining in all or part of an automated data processing system is punishable, at the date of entry into force of the GCU, by two years' imprisonment and a fine of €60,000 (article 323-1, paragraph 1, of the French Penal Code). Where this results in either the deletion or modification of data contained on the Site, or an alteration in the operation of the Site, the penalty is three years' imprisonment and a fine of €100,000 (article 323-1, paragraph 2, of the French Penal Code). Fraudulently introducing data into an automated processing system or fraudulently deleting or modifying the data contained therein is punishable by five years' imprisonment and a fine of €150,000 (article 323-3 of the French Penal Code). It is specified that any subsequent legislative or regulatory amendment which modifies or recodifies all or part of the aforementioned articles of the Penal Code will not affect the substance of the present clause if the offence in question remains existing in the applicable law.-
7. Management of Personal Data
As MEDRIA is a beneficiary of the INNOVAL Group's privacy policy, the User is invited to take full cognizance of the Personal Data Protection Policy at the following address: https: //www.innoval.com/politique-confidentialite.
In any case, the data collected in the context of the contact request (item "Contact us") (title, surname, first name, professional e-mail address, company) are kept during the commercial relationship if the request arises in this sense, then, for three (3) years from the end of this commercial relationship, in accordance with the recommendations of the CNIL. This data is used to personalize the response.-
8. Hypertext links and cookies
8.1. Hypertext links. The Site contains a number of hypertext links to other Internet sites, set up with MEDRIA's authorization. However, MEDRIA is not in a position to check the content of sites visited in this way, and consequently assumes no liability in this respect.
8.2. Cookies. The User is invited to read MEDRIA's Cookie Policy in full at the following address: " Cookie Policy ".-
9. Photo credits
9.1. All photographs, icons and illustrations on the Site are the exclusive property of :
MEDRIA or,
any other entity affiliated with MEDRIA, shareholder or partner of MEDRIA.
9.2 Any partial or complete reproduction, distribution, reproduction, commercialization in original or derived form of these visuals is strictly forbidden without prior written authorization from MEDRIA. Users are prohibited from distributing, reproducing, marketing in original or derived form the content of the Site, under penalty of legal action.
9.3. However, Users may print information from the Site, provided that MEDRIA is expressly cited as the author of said information.-
10. Applicable law and jurisdiction
10.1. The Site is governed by French law.
10.2. If a dispute arises between MEDRIA and the User in connection with the Site, the parties will attempt to resolve it amicably, except in the event of an emergency.
10.3 Exclusive jurisdiction is given to the materially competent court of RENNES, subject to different imperative procedural provisions.

Glossary
User: refers to the Internet user connecting to and using the Site.
Personal Data: means any information relating to an identified or identifiable natural person; An "identifiable natural person" is deemed to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity (Article 4 of the General Data Protection Regulation No. 2016/679 of April 27, 2016 in force as of May 25, 2018 (GDPR) and the amended Act of January 6, 1978).
Data controller: means "the natural or legal person, public authority, department or other body which, alone or jointly with others, determines the purposes and means of the processing" (Article 4, point 7 RGPD).
